Terms and Conditions

Welcome to Mohi Cars (“we,” “us,” or “our”). By renting a vehicle from us, you (“the Renter,” “you”) agree to abide by the following Terms and Conditions. Please read these terms carefully before making a reservation or signing the rental agreement.

1. Definitions

  • “Agreement” means these Terms and Conditions and any separate Rental Agreement you sign at pickup.
  • “Vehicle” refers to any car or other automobile rented from Mohi Cars.
  • “Renter” or “You” refers to the individual or entity entering into the rental agreement with Mohi Cars.

2. Acceptance of Terms

By renting a Vehicle from Mohi Cars, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as any local laws and regulations governing car rentals in Morocco.

3. Eligibility

  1. Age Requirement: You must be at least 21 years old to rent a standard Vehicle. Some premium Vehicle categories may require you to be 25 or older.
  2. License: You must hold a valid driver’s license for a minimum of 2 years. Visitors to Morocco may need an International Driving Permit (IDP) if their national license is not recognized locally.
  3. Identification: A valid passport or national ID card must be presented at the time of pickup.
  4. Payment Method: A valid credit card (or debit card, where accepted) is required for the security deposit and rental fees.

4. Reservations

  1. Booking Confirmation: A reservation is only confirmed once the deposit or required payment has been successfully processed.
  2. Rental Period: The rental period commences when you collect the Vehicle and ends upon its return to the agreed location or time specified in your Rental Agreement.
  3. Extensions: Extensions may be requested before the end of the rental period, subject to Vehicle availability and additional charges.

5. Vehicle Condition and Use

  1. Inspection: Both parties should inspect the Vehicle together at pickup. Any existing damage must be documented in writing or photographed.
  2. Proper Use: You are obligated to use the Vehicle responsibly, obey traffic laws, and avoid any off-road or hazardous use unless specified in the Rental Agreement.
  3. Authorized Drivers: Only individuals listed in the Rental Agreement are permitted to operate the Vehicle.
  4. Prohibited Uses: The Vehicle must not be used for racing, towing, driving instruction, or any illegal activities.

6. Insurance and Liability

  1. Basic Coverage: Unless otherwise stated, our rentals include basic insurance with a deductible. You remain responsible for amounts up to the deductible, plus any damages not covered by insurance.
  2. Optional Insurance: Additional coverage (e.g., Collision Damage Waiver, Personal Accident Insurance) may be purchased to reduce your financial responsibility in the event of damage, theft, or accident.
  3. Accidents: In the event of an accident, theft, or damage, you must immediately notify Mohi Cars and the local authorities, obtaining a police report where required. Failure to follow these steps may invalidate the insurance coverage.
  4. Personal Items: Mohi Cars is not responsible for any personal belongings left in the Vehicle.

7. Security Deposit and Payment

  1. Deposit: A security deposit is required at pickup. The amount depends on the type of Vehicle and level of insurance coverage.
  2. Rental Charges: The total rental cost (including any extras like GPS or child seats) must be paid at the start of the rental or according to the terms agreed upon during booking.
  3. Deposit Refund: Your deposit will be refunded upon the Vehicle’s return in good condition, minus any applicable charges for damages, late returns, or violations. Refund times may vary based on payment method.

8. Fuel Policy

  1. Fuel Level: Unless otherwise stated, we operate a full-to-full fuel policy. The Vehicle is provided with a full tank; you must return it with a full tank.
  2. Fuel Type: You are responsible for using the correct fuel type as indicated by Mohi Cars. Any damage resulting from incorrect fuel usage will be charged to you.

9. Breakdown and Roadside Assistance

  1. Mechanical Failure: If you experience a breakdown, contact Mohi Cars immediately for assistance. We will arrange for repairs or, if necessary, a replacement Vehicle subject to availability.
  2. Unauthorized Repairs: You may not authorize repairs on the Vehicle without prior written consent from Mohi Cars.

10. Cancellations and Refunds

  1. Renter-Initiated Cancellation: If you cancel your reservation, cancellation fees may apply depending on the timing and any specific terms in your booking confirmation.
  2. No-Show: If you fail to collect the Vehicle at the agreed time without notice, we may treat it as a no-show and charge accordingly.
  3. Company-Initiated Cancellation: Mohi Cars reserves the right to cancel your reservation under unforeseen circumstances (e.g., vehicle unavailability, legal restrictions). In such cases, you may be offered a full refund or an alternative Vehicle.

11. Traffic Violations and Penalties

  1. Liability for Fines: You are fully responsible for any parking tickets, speeding fines, toll fees, or other infringements incurred during the rental period.
  2. Administrative Fee: An administration fee may be added for processing any fines or violations on your behalf.

12. Limitation of Liability

To the fullest extent permitted by law:

  1. No Indirect Damages: Mohi Cars shall not be liable for any indirect or consequential damages (including loss of profits or business interruptions).
  2. Maximum Liability: Our maximum liability to you shall not exceed the total rental cost paid.

13. Privacy and Data Protection

  1. Information Collection: We collect personal data to process reservations, provide customer support, and fulfill legal obligations.
  2. Data Sharing: We may share necessary personal data with insurance providers, law enforcement (if required), and third-party service providers involved in the rental process.
  3. Data Security: While we take reasonable measures to protect your data, no system is completely secure. By renting with us, you acknowledge and accept this risk.

14. Indemnification

You agree to defend, indemnify, and hold harmless Mohi Cars, its employees, and affiliates from any claims, damages, losses, or expenses (including attorney fees) arising out of or related to your breach of these Terms and Conditions or misuse of the Vehicle.

15. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the Kingdom of Morocco. Any dispute relating to this Agreement will be subject to the exclusive jurisdiction of the Moroccan courts.

16. Amendments

Mohi Cars reserves the right to update or amend these Terms and Conditions at any time. Any changes will become effective upon posting on our official website. Your continued use of our services following any modifications indicates acceptance of the updated Terms and Conditions.
